Terms of Service

1. Acceptance of Terms
By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site or create an account. The Site is not directed to children.
3. Modifications
We may update these Terms by posting a revised version and updating the "Last updated" date. Changes take effect 30 days after posting. Continued use of the Site after that date constitutes acceptance.
4. Account Registration
You may browse most pages without an account, but some features—including subscribing to individual services—require registration. You are responsible for keeping your credentials confidential and for all activity under your account.
5. Relationship to Service‑Specific Terms
Creating or activating a product (for example, "Smart Search for Ghost") subjects you to the Service Terms for that product ("Product Terms"). If a conflict arises between these general Terms and the applicable Product Terms, the Product Terms control solely for that product. 6. Fees and Billing
Pricing, refunds, billing cycles, taxes, and overage rules are set out in the Product Terms for each service. The Site itself carries no access fee.
7. Acceptable Use
When using interactive areas of the Site (forums, contact forms, feedback widgets) you must not:
- Upload or transmit illegal content, including child sexual abuse material (CSAM).
- Post hate speech or material that incites violence or discrimination.
- Distribute extremist or terrorist propaganda.
- Share personal medical or financial records without lawful basis and explicit consent.
- Violate export‑control or sanctions regulations.
We reserve the right to remove content or suspend accounts that violate this policy.
8. Reasonable Use Limits
All services are subject to reasonable use limits designed to ensure fair access for all users. These limits may include but are not limited to:
- Rate limits on API requests and automated queries.
- Storage, bandwidth, and computational resource quotas.
- Concurrent connection or session limits.
- Restrictions on batch processing or bulk operations.
Exceeding reasonable use limits may result in temporary throttling, service suspension, or account termination. We will make reasonable efforts to notify you before taking action except in cases of abuse or security threats.
9. Prohibited Commercial Activities
You may not use any Visiting Objects service to:
- Create, develop, or operate a competing product or service.
- Resell, sublicense, or redistribute the service or its output without explicit written authorization.
- Extract, scrape, or systematically copy service features, functionality, or data for competitive purposes.
- Reverse‑engineer, decompile, or attempt to derive source code or algorithms from the service.
- Benchmark the service for competitive analysis or public comparison purposes.
- Use the service to provide services to third parties in a way that substitutes for their own subscription.
Violations of these restrictions may result in immediate account termination and legal action.
10. Intellectual Property
All non‑user content on the Site—including text, graphics, and code—is the property of Visiting Objects or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse‑engineer any portion of the Site except as expressly allowed by law.
11. Feedback
You grant Visiting Objects a perpetual, worldwide, royalty-free license to use, modify, and incorporate any feedback or suggestions you submit about the Site or our services.
12. Third‑Party Services
The Site may link to or integrate third‑party services (for example, payment processing by Paddle or privacy‑focused analytics by Plausible). Your use of those services is governed by their own terms; we are not responsible for them.
13. Disclaimer of Warranties
The Site is provided "as is" and "as available." To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
14. Limitation of Liability
To the fullest extent permitted by law, Visiting Objects shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor shall aggregate liability exceed USD 100 or the amount you have paid us in the 30 days preceding the claim—whichever is greater.
15. Indemnification
You agree to indemnify and hold Visiting Objects, its affiliates, and employees harmless from any claim arising out of your use of the Site or violation of these Terms.
16. Termination
We may suspend or terminate your account or access to the Site at any time with or without notice if we believe you have breached these Terms. You may close your account at any time via your dashboard.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of California, excluding its conflict‑of‑laws principles. Any dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that, if you are a consumer resident in the European Economic Area or the United Kingdom, you may bring proceedings in your local courts.
18. Miscellaneous
If any provision is held unenforceable, the remainder stays in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
